Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs your use of MyCreation (the "Service"), available at mycreation.io and operated by an individual sole proprietor, MyCreation ("we", "us", or the "Operator"). By creating an account, purchasing or spending credits, uploading content, or otherwise using the Service, you agree to this Policy. If you do not agree, you must not use the Service.
This Policy is in addition to our Terms of Service and Privacy Policy and is incorporated into them by reference. Capitalized terms not defined here have the meaning given in our Terms of Service.

1. Purpose
MyCreation is a self-serve, general-audience creative tool that lets you build and edit fictional AI personas and produce AI-generated images and videos — for example, creating a character reference sheet, swapping a character into a photo, restyling outfits or body shapes, animating a still image into a short video, replacing a person in a video, and free-form image generation.
The purpose of this Policy is to keep the Service safe, lawful, and welcoming for everyone. It explains what you are allowed to do, what you are strictly prohibited from doing, and what happens when these rules are broken. We take these rules seriously and enforce them.
2. Eligibility and Rights to Your Content
By using the Service, you represent, warrant, and agree that:
- You are at least 18 years old (or the age of majority where you live), and you are using the Service only for lawful purposes.
- You own or have all necessary rights, licenses, consents, and permissions to every photo, video, image, text prompt, and other material you upload or submit ("User Content"), and to create the outputs you generate from it.
- Your use of the Service, your User Content, and your generated outputs do not and will not violate any law or infringe or misappropriate the rights of any other person or entity.
- You are solely responsible for your User Content, your prompts, and the outputs you create, and for how you use, publish, or distribute them.
You must not upload or submit any content you do not have the legal right to use. The fact that the Service can technically process a file does not mean you are permitted to use it.
3. Strictly Prohibited Content and Uses
The following are strictly prohibited. This list is illustrative, not exhaustive — anything similar in nature or intent is also prohibited. You must not use the Service, or attempt to use it, to create, upload, generate, store, distribute, or facilitate any of the following:
- Child sexual abuse material (CSAM) — zero tolerance. Any sexual, nude, suggestive, or exploitative content involving minors, or involving any real or generated person who appears to be, is depicted as, or is described as being under 18. There are no exceptions. We use a strict zero-tolerance standard, we will preserve relevant records, terminate the account, and report violations to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law.
- Non-consensual intimate or sexual imagery. Intimate, nude, or sexual depictions of any real, identifiable person created or shared without that person's consent, including so-called "revenge porn" and undressing or "nudify" uses.
- Sexual, nude, explicit, or pornographic content. The Service is a general-audience product. Creating sexually explicit, pornographic, nude, or otherwise adult sexual content of any kind — fictional or otherwise — is not permitted. The Service is intended for outfit, styling, and body editing of fictional AI personas, not pornography.
- Real, identifiable people without consent. Uploading, depicting, swapping in, editing, or otherwise targeting any real, identifiable individual — including celebrities, influencers, politicians, and other public figures — without their documented, informed consent.
- Impersonation. Creating or using content to impersonate any real person, brand, or organization, or to misrepresent your identity or affiliation.
- Deceptive deepfakes. Creating or distributing manipulated or synthetic media intended to defraud, defame, deceive, or mislead others, or that could reasonably be mistaken for authentic depictions of real events or statements that did not occur.
- Harassment, bullying, hate, and violence. Content that harasses, bullies, threatens, demeans, or sexualizes another person; hate speech or content that attacks or dehumanizes people based on protected characteristics (such as race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age); and content that incites, promotes, or glorifies violence, self-harm, or terrorism.
- Intellectual property and rights violations. Content that infringes another party's copyright, trademark, trade secret, patent, privacy, publicity, or other rights, including unauthorized use of protected characters, logos, artwork, photographs, or a person's name, likeness, or voice (right of publicity).
- Illegal content or activity. Any content or use that is unlawful, that promotes or facilitates illegal acts (including the sale of regulated or illicit goods), or that violates any applicable law or regulation.
- Bypassing safety or usage controls. Any attempt to circumvent, disable, "jailbreak," or defeat our or our AI providers' content filters, safety systems, rate limits, or usage limits, including through obfuscated prompts, encoded instructions, or prompt manipulation designed to elicit prohibited outputs.
- Reselling, scraping, and automated abuse. Reselling, sublicensing, or commercially redistributing access to the Service; scraping, crawling, or bulk-extracting data or outputs; and using bots, scripts, or other automated means to access or overload the Service except as we expressly permit.
- Malware and security abuse. Uploading or distributing viruses, malware, or malicious code, or attempting to probe, breach, disrupt, overload, or gain unauthorized access to the Service, our systems, or other users' accounts or data.
4. Identity and Consent Rule
Every person depicted in your User Content or generated outputs must fall into one of the following two categories:
- A fictional AI persona that you created and that does not depict, imitate, or substantially resemble any specific real, identifiable individual; or
- A real person for whom you hold documented, informed consent to create and use the specific content in question. You must be able to produce evidence of that consent on our request.
If you cannot satisfy one of these two categories, you must not create or upload the content. When in doubt, treat the person as a real individual whose consent is required.
5. AI Provider Content Filters
The Service relies on third-party AI model providers (our generation engines). These providers operate their own independent content-safety and acceptable-use systems. Your requests are also subject to those systems and may be filtered, modified, refused, or rejected by our AI providers at any time, including for reasons beyond our control. We do not guarantee that any particular request will be processed, and a refusal by an AI provider does not entitle you to any remedy beyond the standard handling of credits described in our Terms of Service.
6. Enforcement
We may take any action we consider appropriate to enforce this Policy, with or without notice, including:
- Filtering, blocking, refusing, or removing content, prompts, or outputs;
- Limiting, throttling, suspending, or terminating your account or access to the Service;
- Investigating suspected violations and cooperating with law enforcement; and
- Preserving and disclosing records where required by law or to protect the safety of others.
Serious violations — including any involvement with CSAM, non-consensual intimate imagery, illegal activity, fraud, or attempts to abuse or attack the Service — may result in immediate termination of your account, forfeiture of any remaining credits (which have no cash value and are non-refundable and non-withdrawable), and reporting to the appropriate authorities. You may also be permanently banned from creating new accounts.
We are not obligated to monitor content, but we may do so. Our decision not to act in a particular instance does not waive our right to act in any other.
7. Reporting Abuse
If you encounter content or activity that violates this Policy, or you believe your likeness or rights have been misused on the Service, please report it promptly to support@mycreation.io. Where possible, include relevant details such as a description of the content, links or identifiers, and any context that helps us investigate. We review reports and take appropriate action.
8. Changes to This Policy
We may update this Policy from time to time to reflect changes in our Service, our AI providers' requirements, legal obligations, or best practices. When we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Policy.
