MyCreation Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "your", or the "user") and the operator of MyCreation ("we", "us", "our", or the "Operator"). Please read them carefully before using the service.

1. Acceptance of Terms & Who We Are

MyCreation is a self-serve web application available at mycreation.io (the "Service") that lets you create and edit AI-generated images and videos featuring fictional "AI influencer" characters and personas.

The Service is operated by MyCreation, an individual sole proprietor (not a company), referred to in these Terms as the "Operator", "we", "us", or "our".

By creating an account, purchasing credits, or otherwise accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Acceptable Use Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time as described in Section 16.

2. Eligibility

To create an account, purchase credits, or use the Service, you must be:

• At least 18 years old, or the age of majority in the jurisdiction where you live, whichever is greater; and
• Legally capable of entering into a binding contract and not barred from using the Service under any applicable law.

By using the Service, you represent and warrant that you meet these requirements. The Service is not directed to children, and we do not knowingly allow anyone under 18 to use it. If we learn that an account belongs to someone who does not meet these eligibility requirements, we may suspend or terminate that account.

3. Accounts & Security

• You access the Service by signing in through our third-party authentication / sign-in provider, which associates your account with your email address.
• You are responsible for all activity that occurs under your account.
• You agree to keep your sign-in credentials confidential and to maintain the security of any third-party account you use to access the Service.
• You agree to provide accurate information and to notify us promptly at support@mycreation.io if you suspect any unauthorized access to or use of your account.
• You may not share, sell, transfer, or assign your account to another person, and you may not create an account on behalf of someone else without authorization.

We are not liable for any loss or damage arising from your failure to protect your account or credentials.

4. The Service — What MyCreation Does

MyCreation provides tools to create and edit AI-generated media featuring fictional characters. Depending on the features available, the Service may let you:

• Build a character reference sheet for an AI persona;
• Swap a character into a photo;
• Restyle outfits or body of a fictional persona;
• Animate a photo into a short video;
• Replace a person in a video; and
• Perform free-form image generation.

Generation is powered by third-party AI model providers (our generation engines). The features, models, capabilities, and outputs of the Service may change, improve, or be discontinued over time. We do not guarantee that any particular feature, model, or result will be available at any given time.

5. Credits, Wallet & Payments

The Service operates on a prepaid credit model. There is no subscription; you pay per generation.

How credits work

• You add funds to a prepaid wallet by topping it up with cryptocurrency through our third-party cryptocurrency payment processor.
• Top-ups are converted into credits that are denominated internally within the Service.
• Credits have no cash value, are not a deposit or stored-value instrument, are not redeemable, exchangeable, or withdrawable for money or cryptocurrency, and may be used only to pay for generations within the Service.

Pricing and spending

• Each generation costs a number of credits. The price is shown and confirmed before any credits are spent.
• Credit prices for generations may change over time. Any change applies to generations made after the change takes effect; the price you confirm at the time of a generation is the price that applies to that generation.

Cryptocurrency payments

• Cryptocurrency payments are irreversible by nature. Once a top-up transaction is confirmed on the network, it cannot be reversed, canceled, or charged back by us.
• You are responsible for sending the correct amount to the correct address using the correct network. We are not responsible for funds lost due to user error, network issues, sending unsupported assets, or sending on an unsupported network.
• Top-up processing is handled by our third-party cryptocurrency payment processor and is subject to that processor's own terms, timing, and availability.

Taxes

• Any taxes, duties, or similar charges arising from your purchase or use of credits or the Service are your responsibility. Prices shown do not include taxes unless stated otherwise.

6. Refunds

• If a generation fails, the credits for that generation are automatically refunded to your wallet, and you are not charged for the failed generation.
• Successful, completed generations are final and the credits consumed are non-refundable.
• Because cryptocurrency top-ups are irreversible, wallet top-ups themselves are generally not refundable to cash or cryptocurrency.

7. User Content & Uploads

"User Content" means the images, videos, text prompts, and other materials you upload to or create with the Service.

Your ownership

• As between you and us, you retain ownership of the User Content you upload. We do not claim ownership of your User Content.

License you grant to us

• You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, and display your User Content solely to operate and provide the Service to you — including by transmitting it to our third-party AI model providers and other providers described in Section 11.
• This license lasts only as long as needed to provide the Service and to comply with our legal obligations.

Your representations & warranties

By uploading or submitting User Content, you represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to the User Content and to use it with the Service;
• Your User Content and your use of it do not infringe or violate any third party's intellectual property, privacy, publicity, or other rights;
• You have obtained any required consents from any identifiable person depicted in your uploads; and
• Your User Content complies with these Terms and our Acceptable Use Policy and with all applicable laws.

You are solely responsible for your User Content and for the consequences of uploading or using it.

8. AI-Generated Output

"Output" means the images, videos, and other media generated by the Service in response to your inputs.

• Output is provided "as is". AI generation is probabilistic, and we do not guarantee that Output will be accurate, suitable, error-free, or fit for any particular purpose.
• Output may not be unique. Because the generation engine may produce similar results for different users or prompts, your Output may resemble other users' Output. We do not promise exclusivity or uniqueness in any Output.
• You are responsible for how you use Output, including ensuring that your use complies with applicable law and does not infringe or violate the rights of others.
• Ownership and permitted use of Output are subject to applicable law, including laws governing the protectability of AI-generated material. We make no representation that any particular Output is protectable or owned by you.

9. Acceptable Use

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms. Among other things:

• Sexually explicit or pornographic content is not allowed. The Service provides styling, outfit, and body editing of fictional AI personas, not pornography.
• You may not use the Service to create content that is illegal, abusive, deceptive, or harmful, or that violates the rights of others.

We may, at our discretion and without notice, refuse, filter, limit, or remove content, and suspend or terminate access, where we believe these Terms or the Acceptable Use Policy may be violated. In addition, our third-party AI model providers apply their own content filters, which may block or alter certain requests or outputs independently of us.

10. Intellectual Property of the Service

The Service — including its software, design, user interface, text, graphics, logos, and other materials we provide (excluding User Content and Output) — is owned by the Operator or our licensors and is protected by intellectual property and other laws.

• We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms.
• You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service, except as permitted by law.
• "MyCreation" and related names and marks are our property. Nothing in these Terms grants you any right to use them without our prior written permission.

11. Third-Party Services & Providers

To deliver the Service, we rely on third-party providers, referred to here only by category:

• our cloud hosting & database provider;
• our authentication / sign-in provider;
• our third-party cryptocurrency payment processor; and
• third-party AI model providers (our generation engines).

These providers have their own terms and policies, and parts of the Service depend on their availability and performance. We are not responsible for the acts, omissions, availability, pricing, or content policies of these third parties. Your use of features powered by third-party providers may be subject to their terms in addition to these Terms.

12. Disclaimers

• The Service, including all features, credits, and Output, is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory.
• To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that any Output will meet your expectations or requirements; or that any particular result will be achieved.
• You use the Service and any Output at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law:

• We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Service, even if we have been advised of the possibility of such damages.
• Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amounts you paid us for credits in the three (3) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
• Because credits have no cash value and are non-withdrawable, our liability with respect to credits is limited to restoring the affected credit balance to your wallet where we determine, in good faith, that a credit error occurred.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Operator from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• your User Content and the rights or consents associated with it;
• your use of the Service or any Output;
• your violation of these Terms, the Acceptable Use Policy, or any applicable law; or
• your violation of any rights of a third party.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.

15. Suspension & Termination

• You may stop using the Service at any time.
• We may suspend, restrict, or terminate your access to all or part of the Service, with or without notice, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, if required by law, to protect the Service or other users, or for security reasons.
• Upon termination, your right to use the Service ends. Because credits have no cash value and are non-withdrawable, any remaining credit balance is generally forfeited upon termination for a violation of these Terms, except where applicable law requires otherwise.
• Sections that by their nature should survive termination — including those on User Content licenses, Output, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

16. Changes to the Service & to These Terms

• We may modify, add, remove, or discontinue features of the Service at any time, including AI models and generation capabilities.
• We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice (for example, on the website).
• Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

17. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.

Informal resolution first

• Before bringing any formal claim, you agree to first try to resolve the dispute informally by contacting us at support@mycreation.io. We will try in good faith to resolve the matter. If we cannot resolve it within 30 days, either party may pursue formal action.

Venue

• Subject to applicable law, you agree that any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of those courts.
• Each party will bear its own costs except as otherwise required by law.
