This Privacy Policy explains how we collect, use, share, and protect personal information when you use MyCreation (the "Service"), available at mycreation.io. By creating an account or using the Service, you agree to the practices described here.

1. Scope & Who We Are

MyCreation is a self-serve web application that lets users create and edit AI-generated images and videos featuring fictional "AI influencer" personas. Features include building a character reference sheet, swapping a character into a photo, restyling outfits and body, animating a photo into a short video, replacing a person in a video, and free-form image generation.

The Service is operated by an individual sole proprietor, MyCreation (referred to in this policy as the "Operator", "we", "us", or "our"). We are based in the United States.

This Privacy Policy applies to personal information we collect through the Service. It does not cover third-party websites, applications, or services that we do not control.

You must be at least 18 years old (or the age of majority where you live) to use the Service. See Section 8.

2. Information We Collect

We collect the following categories of information:

Account information

• Account email, provided through our third-party authentication / sign-in provider when you sign in. We do not receive or store your sign-in password.

Wallet & transaction information

• Wallet balance (your prepaid credit balance, denominated internally).
• Transaction and payment records, including credit top-ups, generation charges, automatic refunds for failed generations, timestamps, and related metadata. Cryptocurrency payments are processed by our third-party cryptocurrency payment processor; we do not collect or store your private keys or wallet credentials.

Content you submit and create

• Images and videos you upload to the Service.
• Text prompts you write.
• Generated outputs (the images and videos the Service produces for you).

Technical & usage data

• Limited technical data, such as your IP address, device and browser information, and basic usage logs. We use this primarily for security, abuse prevention, and rate-limiting.
• Cookies and session data used to keep you signed in and to operate the Service. For details on cookies and similar technologies, see our Cookie Policy.

3. How We Use Your Information

We use the information we collect to:

• Provide and operate the Service, including maintaining your account, displaying your wallet balance, and delivering the features you use.
• Process generations, including sending your uploads and prompts to third-party AI model providers (our generation engines) so they can produce your requested output, showing and confirming the credit price before you spend, charging credits for successful generations, and automatically refunding credits to your wallet when a generation fails.
• Process payments and maintain records, including crediting your wallet after top-ups and keeping accurate transaction records.
• Prevent abuse and fraud, including detecting misuse, enforcing our Terms, applying rate limits, and protecting the security and integrity of the Service.
• Communicate with you, including responding to support requests and sending important Service or account notices.
• Comply with law, including meeting legal, tax, accounting, and regulatory obligations and responding to lawful requests.

We process your information based on your agreement to our Terms, our legitimate interest in operating and securing the Service, and our need to comply with legal obligations.

4. How We Share Information / Subprocessors

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as described below.

Service providers (subprocessors), by category

We rely on a small number of trusted third-party providers to operate the Service. We share information with them only as needed to provide the Service, and we describe them by category only:

• Our cloud hosting & database provider — stores account data, wallet and transaction records, uploads, prompts, and generated outputs, and runs the Service infrastructure.
• Our authentication / sign-in provider — verifies your identity and enables secure sign-in.
• Our third-party cryptocurrency payment processor — processes cryptocurrency top-ups to your prepaid wallet.
• Third-party AI model providers (our generation engines) — receive the content you submit (uploaded images and videos, prompts, and reference material) in order to perform the requested generation and return the output.

Important — AI providers process your submitted content. When you run a generation, the images, videos, and text prompts you submit are sent to third-party AI model providers so they can produce your output. This processing is necessary to deliver the feature you requested. Please do not submit content you are not permitted to use or that you do not want processed by these providers.

Legal and protective disclosures

We may disclose information when we believe in good faith it is necessary to comply with the law or a lawful request, enforce our Terms, prevent fraud or abuse, or protect the rights, safety, and property of our users, the public, or us.

Business transfers

If the Service is involved in a sale, merger, financing, or transfer of assets, your information may be transferred as part of that transaction, subject to this policy.

We do not sell your personal information for money or other valuable consideration.

5. Data Retention

We keep personal information only for as long as needed for the purposes described in this policy, unless a longer retention period is required or permitted by law.

• Account and transaction data — kept while your account is active and for as long as required to meet our legal, tax, accounting, and record-keeping obligations and to resolve disputes. Transaction records may be retained after account closure where the law requires.
• Generated media (outputs) — hosted temporarily and automatically deleted by the processing providers after roughly 30 days.
• Uploaded images and videos — retained for the period needed to process your request and operate the Service, and likewise subject to automatic deletion by the processing providers on a comparable timeframe.
• Technical and security logs — retained for a limited period for security, abuse prevention, and rate-limiting.

When information is no longer needed, we delete it or de-identify it where feasible.

6. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, and alteration. Examples include access controls, encryption in transit, and reliance on reputable infrastructure and payment providers.

However, no method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security. You are responsible for keeping your sign-in credentials and the security of the wallet you use to fund top-ups.

7. Your Privacy Rights

Depending on where you live, you may have rights over your personal information. We honor the rights described below for all users where applicable.

California residents (CCPA / CPRA)

If you are a California resident, you have the right to:

• Know / Access — request the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties with whom we share it.
• Delete — request that we delete personal information we have collected about you, subject to legal exceptions.
• Correct — request that we correct inaccurate personal information.
• Opt out of sale or sharing — opt out of the "sale" or "sharing" of personal information. We do not sell or share your personal information, so there is nothing to opt out of, but you may still submit a request.
• Non-discrimination — you will not receive discriminatory treatment for exercising your privacy rights.

How to exercise your rights

To make a request, email us at support@mycreation.io. We will take reasonable steps to verify your identity before acting on your request, and we will respond within the timeframes required by applicable law. You may use an authorized agent to submit a request on your behalf where the law permits.

8. Children

The Service is intended for adults only. You must be at least 18 years old (or the age of majority where you live) to create an account and purchase credits. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us with personal information, please contact us at support@mycreation.io, and we will take steps to delete it.

9. International Users

We are based in the United States, and your personal information is processed and stored in the United States and in other locations where our service providers operate. If you access the Service from outside the United States, you understand that your information will be transferred to, processed in, and stored in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer and processing.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the Effective date above and post the updated policy on mycreation.io. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after the changes take effect means you accept the updated policy.
